The Trip Participant Contract
VERY IMPORTANT Please read carefully. This is a legal contract.
Insurance:
We require that you protect yourself with a travel insurance policy
covering accidents, trip cancellation and emergency evacuation.
Guest Responsibility:
It is vital that persons with medical problems make them known to
us well before departure. Trip members have a responsibility to
select a trip appropriate to their ability and interest. The trip
leader has the right to disqualify anyone at any time if he or she
feels the trip member is incapable and/or the trip member’s
participation will endanger the other trip members. Failure to adhere
to directions established by the trip leaders may result in being
asked to leave the trip. If you are asked to leave the trip for
any reason, you are responsible for all incurred expenses. No refund
will be given.
Assumption of Risk and Waiver of Liability:
Back-country and international travel has danger and risks. I acknowledge
that the risk exists, including but not limited to hazards of travel
in jungles, mountains, high altitudes, steep terrain, travel by
boat, raft, jeep, horse, hot air balloon, bicycle or other conveyance.
I further acknowledge that the forces of nature, crime, civil unrest
and personal injury or illness in remote areas without means of
rapid evacuation or adequate medical care are all risks which exist
in adventure travel. I agree that Alto Quepos Real Estate and
its agents and employees shall have no liability regarding the adequacy
of medical care and medical supplies that may be provided. I agree
to assume all risk of death, injury to myself, or my child, and
damage or loss of my personal property. I alone am responsible for
my, or my child’s actions. Should I, or my child become ill
or injured, I will pay all costs of evacuation and medical care
that I, or my child might receive. I HEREBY RELEASE Alto Quepos Real Estate, its agents/employees and anyone acting in concern with
them from any liability resulting from my, or my child's participation
in a Alto Quepos Real Estate sponsored trip or program. The terms
contained herein shall serve as a waiver of liability of the trip
operator and an assumption of risk on my, or my child's behalf,
my heirs, executors, administrators, successors and assigns for
any and all known or unknown personal injuries, emotional trauma
and suffering, financial loss and/or property damage or loss. Should
any suit or legal action be brought against the trip/program operators
and sponsors it is agreed that such suit shall first be attempted
through Alternative Dispute Resolution before relying on litigation.
In case of litigation, it is agreed that the suit shall be brought
only in a court of jurisdiction within Costa Rica. I agree that
if I or my heirs or anyone acting on their behalf should bring such
suit that I/they shall pay all attorney fees, related court and
defense costs should I/they not prevail. Should any part of this
contract be found invalid or not enforceable by a court of law,
then the remaining portion shall continue to be valid and in force.
No other modifications are allowed. This document forms the entire
agreement.
My signature below certifies that I have carefully read the entire
contract and understand and agree to comply with all of its terms
and provisions. I certify that I have read the detailed description
of the trip that I am joining and believe that I am physically and
mentally capable of participation. I am voluntarily participating
with knowledge that dangers are involved and I agree to assume all
risk.
I hereby give my full and informed consent for my child to participate
in this multi-day adventure trip. I understand that adventure travel
has inherent risks, and do not hold Alto Quepos Real Estate responsible
for injury resulting from participation in this trip. I understand
that experienced guides will be leading the trip, and that it is
my and my child's responsibility to follow the guides' instructions.
